Rental Agreement
Please read this agreement carefully before renting equipment. By signing the rental receipt or taking possession of equipment, you agree to all terms below.

1. Parties
This Rental Agreement ("Agreement") is between Equipment Sales NW, located at 1234 Columbia River Hwy, Troutdale, OR 97060 ("Company"), and the individual or entity taking possession of the rented equipment ("Renter"). By signing the rental receipt or taking possession of equipment, the Renter agrees to be bound by this Agreement.
2. Identification & Eligibility
- Renter must be 18 years of age or older
- A valid government-issued photo ID (driver's license, state ID, or passport) is required at pickup
- The Company reserves the right to refuse rental to any individual at its sole discretion
- Renter must be physically present at pickup; equipment may not be picked up by a third party without prior written authorization
3. Rental Period & Rates
Rental rates are charged per the period selected at booking (daily, weekend, or weekly). The rental period begins at the time of pickup and ends at the agreed return time.
- Daily: 24-hour period from time of pickup
- Weekend: Friday pickup through Monday 9 AM return
- Weekly: 7 consecutive days from time of pickup
Late returns will be charged at the daily rate for each additional day or partial day. The Company must be notified of any extension before the scheduled return time.
4. Deposit
A refundable security deposit equal to one day's rental rate for the rented equipment is collected at pickup. The deposit will be returned in full upon return of the equipment in the same condition as rented, with a full fuel tank, and with no missing or damaged components. Deposits may be forfeited in whole or in part to cover damage, missing parts, fuel, or cleaning fees.
5. Fuel Policy
All equipment is rented with a full tank of fuel. Equipment must be returned with a full tank. If equipment is returned with less than a full tank, the Company will charge a refueling fee of $15 plus the cost of fuel required to refill the tank. Renter is responsible for using the correct fuel type as specified on the equipment or by Company staff at pickup.
6. Renter Responsibilities & Permitted Use
The Renter agrees to:
- Operate equipment only for its intended purpose and within its rated capacity
- Operate equipment only on property the Renter owns or has permission to access
- Not allow any person other than the Renter to operate the equipment without prior written consent from the Company
- Not transport equipment across state lines without prior written consent
- Not use equipment for commercial hire, subletting, or resale
- Inspect equipment at pickup and report any pre-existing damage before leaving the premises
- Secure equipment during transport and storage to prevent theft or damage
- Return equipment clean and free of excessive mud, debris, or plant material
7. Damage & Loss
The Renter is responsible for all damage to or loss of rented equipment during the rental period, regardless of cause, including theft, vandalism, weather, or operator error. Damage charges will be assessed at the Company's cost to repair or replace the equipment. The Renter's deposit will be applied first; any remaining balance is due within 14 days of written notice. The Company will photograph equipment at pickup and return to document condition. Renter is encouraged to photograph equipment at pickup as well.
8. Delivery & Pickup Service
Equipment delivery and return pickup is available within 20 miles of Troutdale, OR for a flat fee of $100. This fee covers one delivery and one return pickup. The Renter is responsible for ensuring a safe, accessible delivery location. Delivery fees are non-refundable once delivery has been completed. The Company is not responsible for delays caused by inaccessible delivery locations or unsafe conditions.
9. Breakdown & Mechanical Issues
If rented equipment breaks down or malfunctions during the rental period through no fault of the Renter, the Renter must notify the Company immediately at (503) 869-2641. Do not attempt to repair equipment yourself. The Company will arrange a replacement or issue a pro-rated refund for downtime at its discretion. No refunds are issued for breakdowns caused by misuse, overloading, or improper operation.
10. Limitation of Liability & Indemnification
The Renter assumes all risk of personal injury, property damage, and third-party claims arising from the use of rented equipment. The Company is not liable for any injury, damage, or loss resulting from the Renter's use of the equipment. The Renter agrees to indemnify, defend, and hold harmless Equipment Sales NW, its owners, employees, and agents from any claims, damages, or expenses arising from the Renter's use of the equipment during the rental period.
11. Cancellations & Refunds
- Cancellations made 24+ hours before the scheduled pickup receive a full refund
- Cancellations made less than 24 hours before pickup may be subject to a one-day rental fee
- No refunds are issued for early returns once the rental period has begun
- Delivery fees are non-refundable once delivery has been completed
12. Governing Law
This Agreement is governed by the laws of the State of Oregon. Any disputes arising under this Agreement shall be resolved in Multnomah County, Oregon.
